又赶房客
二年前，我写过我们做地产管理，驱逐过四起房客，常在河边走，那能不湿鞋，这种事再小心，也会重复。今年元旦过后的某天，我们同 时在为两起驱逐房客的事奔波，早8:30赶到一个县的法庭庭审， 中午12点赶到另外一个县lock out，其中庭审的案例是首次遇见，也让我们吃一堑长一智，自此后，我们在购房合约会加上能使卖家过户后及时搬家的条款，也算一种另类的收获。
这个庭审的案子，我们完全是被动的房东。房子是去年9月初正常过户的，过户后，卖家一直找理由不搬出去。 房子是前后各一套， 卖家住前套，他儿子住后套。经过卖家经纪的一再恳求，半个月后，卖家搬出前套，他儿子还是不搬。我们只得跟儿子再交涉， 他终于同意并立字据，再住十天到十月一日搬走，付6百美元作为10天房租。无赖总是无赖，十月一日到了，儿子不搬，并提出$1300现金换钥匙(cash for key)。当时正好做装修的工人在前套房估价，他说最多$500就能让他走，因为当他在前套装修时， 会不断地制造各种噪音昼夜吵他，他受不了时再跟他谈判。 只是等了这哥们一个多月还没开工。等再跟这儿子交涉时， 他己要cash for key $4000了。没办法，只好找律师驱逐房客了。一开始找了我们用过的白人律师，当时他在外休假，秘书没有告诉我们，只是用各种理由糊弄了我们半个月。实在等不起了， 我们只好又换了一家专做赶房客的律师。我们把情况跟他说了，他说这儿子在里面住了超过两星期，就是resident了，需要给他60天的通知，然后才能赶他。一听这个，我们有点急了， 突然想起他给我们立过字据，那不是最好的契约终止吗？律师看了那字据，说三天通知都不需要了，直接去法庭递了unlawful detainer. 当然被告，卖家及儿子在五天内回应并否认所有指控，没办法只能安排庭审。庭审前，律师动员我们，为防被告提供假证据，做个证据调查(discovery), 然后再根据证据, 可提动议(motion in limine )撤销庭审，或至少让法官了解更多证据。我们知道被告是无赖， 完全可以编造证据，就同意了律师做调查，另付了$300。但实际上被告也没有回复，想想这么简单明确的案子，用不着这么复杂，就没有同意再付$350提动议了，只是前面300块就白扔了。
元旦后那天八点半开庭，我们准时到达。被告姗姗来迟, 九点后才到，我们律师找他们想协商一下，他们一口拒绝。快十点开庭， 双方发誓后，我们原告律师简单向法官陈述情况及我们的要求， 随后被告由卖家儿子答辨，他侃侃而谈，编了一堆理由，首先说， 住在里面是因为我们要求他装修，然后说我们停水停电， 再后来说是我们应该给他现金，他才应该搬走。 其间法官简单回问了我们几个问题，包括现金换钥匙是否达成， 也问了被告水电原来在谁的名下。之后案子对法官来说应该很清楚了，但被告儿子还在不断地说， 最后说他爸爸卖房前跟他签过租房协议，是到12月1号， 法官明显不耐烦的问他，现在已经一月了，你到底要住到什么时候？ 法官又问他，你要我为你做什么? 你来法庭目的是什么？且重复了四次。这儿子吭哧了好一会儿， 最后说要给他1300现金才行。法官实在不想听他说了，宣布休庭，并告之判决会随后寄给原，被告。今天律师来电，we won. 这是预料中的结果, 只是这案子还要磕下去，我们也会再告他赔偿所有的损失。

DHgate will not let me add pictures to this review, but know the shoes look amazing. The fit and quality are good, too. I ordered a size 45 EU or 11 US and they seem a tiny bit small but still good. I received them after a 4 week wait without any problems. I will definitely recommend and buy from this seller again. I wish I could show you the pictures but I’m unfortunately unable to add them.

The boots are sooo cute. The shipping took a month and two days. I ordered on the 10th of November and got them December 12th. I paid for FedEx shipping and the tracking was not really reliable until a week and a half ago. I can’t wait to wear them for my birthday! Sizing wise they were a half a size to big for me but I expected that, I wear a exact size 6 in womens but I have wide feet and I got the size 38. (Yes they are darker in person!) Also the boots have scuff marks all over them but they are not that noticeable unless you have them in your face.
